Third Party Claims

Los Angeles Third-Party Claims Lawyers

Injured at Work Due to a Third Party’s Negligence?

If you have been injured while on the job due to the negligence of another person or entity besides your employer, you may have the option of filing two claims. One is a workers’ compensation claim through your employer and the other is a personal injury claim against the negligent party, referred to as a third-party claim.

If you believe that your injuries were substantially contributed to or caused by such a third party, it can be in your best interests to seek skilled legal counsel. At LA Workers' Comp Attorneys, we can review your case to determine if a third party should be held liable for your injuries. With over 50 years of experience and extensive resources, our firm is adept at handling even the most complicated injury cases. It will cost you nothing to get started through our free initial consultation.

Compensation under Third-Party Claims

Third-party claims may be made against anyone other than your employer whose negligence caused or contributed to your accident. Examples of third parties include defective product manufacturers as well as another driver if you were injured while driving a company vehicle as part of your work duties.

Compensation for which you may be eligible under a third-party personal injury claim includes:

  • Medical and hospital expenses, both past and future including physical therapy, dental work, medications, medical equipment, and psychological treatment
  • Lost wages, both past and future
  • Pain and suffering, both past and future
  • Loss of enjoyment of life, emotional distress, and/or inconvenience
  • Any personal property damages, such as if you were driving your own vehicle
  • Any other damages that California law allows

Workers’ compensation benefits do not include non-tangible damages such as those for pain and suffering, emotional distress, and the like.

Examples of third-party claim situations would include dog attacks on delivery personnel, accidents caused by working with defective machinery, or while driving a company vehicle that is a defective product.
